Police? “Yes, this guy has a gun on me,” said….the burglar!

A Texas burglary suspect called 911 early Tuesday morning to report that a homeowner was holding him at gunpoint and threatening to shoot him, KDFW reports.

Homeowner James Gerow said he awoke at around 12:30 a.m. and found a man wearing dark clothes and a hoodie inside his Springtown home. He then retrieved his legally owned gun and followed the man out to a truck that was parked in his driveway.

Wielding his firearm, Gerow ordered the suspected burglar to give him the keys to the vehicle and told his wife to call 911 while he held the suspect at gunpoint.

“Yeah, hurry up now. He says my husband’s fixing to shoot him,” she reportedly told the dispatcher.

…Moore was later arrested for burglary of habitation, a second-degree felony.

…“I gave him a chance…Had he said he had bad intentions before that, he wouldn’t have got his second chance. That’s a different ballgame. You threaten me and my family, that’s a different ballgame,” Gerow added.

If Gerow wouldn’t have had his gun, there could have been a struggle, he could have been disabled or killed and then his family would have been at the burglar’s mercy. Bob Costas would probably argue that should have been exactly what happened. But, when the bad guy with “bad intentions” ends up so terrified for HIS LIFE that he has to call the police, that sounds like a great ending to what could have potentially been a tragic situation.

    One of the things that happens from decisions we make are consequences, the burglar wasn’t to smart if he didn’t believe he was putting his life at risk when he broke into another persons house with the intent of stealing what was not his….any idiot would know that there is always a chance you would see the end of a gun pointed at you because Oh my God, your breaking the law and for them to arrest a man for protecting what was HIS from someone that wanted what WASN”T His is beyond belief…..terrified for HIS LIFE? One thing about this crook he sure didn’t give much thought about the consequences of trying to take something from someone else, and breaking into the house, he broke the law…what happened to that way of thinking instead today we feel sorry for the idiot because he felt his life was threatened??? My first instinct if someone broke into my home, would be to shoot first and ask questions later. But I’m a grandmother raising my granddaughter, whom I will defend to the death.     Sounds to me like the burglar would have left peacefully. The homeowner FOLLOWED him outside. Doing so could have initiated violence.

    I own guns, so don’t paint me as a liberal gun-hater. If someone was in my home threatening me I wouldn’t have a problem defending myself. Defense ends when you start following the burglar.

      The mainstream media looks at the bigger picture and the dangers firearms possess, not to mention the fear that an armed society inspires in the minds of its people rather than the macho “hunter hunted” stories that conservative groups use to galvanize their followers into outspoken support for the upholding of a two century old amendment that had pistols and muskets, not Uzis and assault riflies, in mind.

      YOU missed the point, the bad guy was caught and held at gunpoint, he was not shot .End result: one asshole off the street, no one hurt. So you are telling me that if you found a guy in your home at 0 dark thirty and had the means to detain him you would just let him go and not attempt a citizens arrest, which is pretty much what happened here because a forcible felony was committed. If I was a burglar I would come to your house, maybe you would leave me out some milk and cookies.

    The story leaves out the part about where Lance – the misguided thief” jumped in his own car and called 911 to let them know a guy had a gun on him. Also the owner of the home parked his 4X 4 in front of Lances car so he could not leave – the homeowner instructed his 13 year son that if the guy tried to jump out of the car and run to shoot him in the leg with the 12 ga that the boy had.
    Now that is how it is done in Texas.

            Cindy, while I lived in WA, a guy shot and killed one of two kids crawling out his window in either Lynwood or Bothell (about 20 years ago), no charges filed; and Lewis County didn’t charge an old gent who shot and killed a guy who had previously robbed him when the guy came back for a rerun but tried to escape when he realized the owner was armed and dangerous. This was about 4 or 5 years ago.

          Several times over the last 20 years or so, Washington state has declined to prosecute guys who shot and killed intruders & trespassers (sometimes in the back) as they crawled out a window or were trying to leave following attempted robberies. Not saying this was the best way to handle things, but it does cut way down on recidivism… Interestingly, Washington is about as liberal as it gets in most other ways…

        Texas has the Castle Law .. either life or property that belong to you domain can be protected by lethal force .. only consequence is if the State or a civil party can prove there was no harm intended (near impossible to prove in Texas, thankfully) by tresspassing and you shoot them, you then are liable to prosecution

          Actually, a specific portion of that law states the perpetrator or his agents CANNOT sue for damages resulting from their actions. It’s not allowed. In fact, since 2007 no challenges to this law have been successful.

        Brett, according to 2007 Texas Castle Doctrine all of the old myths about dragging them back in the house, reckless endangerment and the thief’s relatives can sue you is all gone in Texas. If ANYONE is on your property(inside or out) OR in a property you have a legal right to be and you feel immediately threatened or in danger you may shoot them under the law. Citizens are not bound by the same Code of Conduct LEO’s are. We have much more latitude in Texas to deal with them. It works.

        In Texas, even if he is running away, if he has your property, you can shoot him. A repo guy was shot by a landowner and it did go to court. The landowner won due to an 1873 law that clearly stated you had the right to shoot anyone stealing your property.

      If you are using Federal ammo that is simi jacketed hollow points, the speed is 1250 feet per second. Not quite as fast as the ball ammo that gets there in 1400 FPS but potentially a bit better at stopping all agressive behavior.
